16.01.2015 Heard learned counsel for the Petitioner and the State.

The Petitioner seeks bail in Hajipur Town P.S. Case No. 838 of 2014 registered under Sections 25(1-B) A, 26 and 35 of the Arms Act pending before the Chief Judicial Magistrate, Vaishali at Hajipur.

Considering that while on bail the Petitioner was roaming around with arms and, thus, has misused the privilege of bail, I am not inclined to grant bail to him at this stage. The prayer for bail is rejected.

However, the Petitioner may renew his prayer for bail after framing of charge since only two cartridges were recovered from his possession if his case is not bifurcated for the said purpose.

The Trial Court is directed to expedite the trial

Patna High Court Cr.Misc. No.1390 of 2015 (2) dt.16-01-2015 and for which reason is shall send a list of the witnesses fixing specific dates for production of the witnesses along with a copy of this order, to the Superintendent of Police, Vaishali at Hajipur, and the Superintendent of Police, Vaishali at Hajipur is directed to ensure production of the witnesses on the date so fixed by the Trial Court so that there is no further delay in trial.
