====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-06-2020 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State through video conferencing.

Petitioner is in jail custody since 30.05.2019 in connection with Andhramath P.S. Case No. 84 of 2019 registered for the offences punishable under Section 302 and other allied sections of the Indian Penal Code and 27 of the Arms Act.

The first information report goes to show that alleged occurrence took place on account of land dispute and allegedly, petitioner opened fire which hit to injured Ganga Ram Mandal. Perusal of case diary goes to show that the investigating officer failed to collect the injury report of injured Ganga Ram Mandal. Moreover, para 11 and 12 of the case diary go to show that petitioner as well as some co-accused had sustained injury in the alleged occurrence and they got treated themselves at the hospital. The investigation against the petitioner has already been completed and petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of period of detention of the petitioner in jail custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st Madhubani in connection with Andhramath P.S. Case No. 84 of 2019.
