The petitioner seeks regular bail in connection with Case No. C2/725/19 for the offence registered under Section 30(A) of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of 35 litres of sprit from a three wheeler which belongs to the petitioner. The learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case. It is further submitted that the petitioner is having a clean antecedent. Lastly, it is submitted that the petitioner is languishing in custody since 01.12.2019.

Having regard to the facts and circumstances of the

No.2302 of 2020(2) dt.16-01-2020 2/2 case, considering the submissions made by the learned counsel for the petitioner coupled with the fact that the petitioner is having a clean antecedent, I deem it fit and proper to direct for release of the petitioner herein on regular bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-II-cum-Special Judge, Excise Act, Sitamarhi in connection with Case No. C2/725/19.
