JUSTICE SATYAVRAT VERMA ORAL ORDER 04-03-2022 Heard learned counsel for the petitioner and learned APP for the State through virtual proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in connection with Aurangabad Excise Case No. 1548 of 2021 registered under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018.
Learned counsel for the petitioner submits that the petitioner is in custody since 07.11.2021, charge-sheet has been submitted and is a persons with clean antecedent and allegation is of recovery of 91.500 litres of liquor from a Tempo. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.3346 of 2022(2) dt.04-03-2022 2/2 petitioner was a passenger of the said Tempo and as such he was not knowing what was kept in the Tempo.
Learned APP opposes the bail application.
Considering the fact that the petitioner is in custody, charge-sheet has been submitted, is a person with clean antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.2000/- (Rupees two thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum- Special Judge, Excise Act, Aurangabad in connection with Aurangabad Excise Case No. 1548 of 2021.
