2. Learned counsel for the petitioner submits that the petitioner was granted bail vide order dated 19.10.2023 passed in Cr. Misc. No.68432 of 2023 but only after framing of charge. Counsel submits that when the charge has not been framed, the petitioner has moved before this Court in present Cr. Misc. No. 13892 of 2024 in which a report about the present stage of the trial has been called for. The report indicates that the charge has been framed on 13.03.2024 and record of other absent two accused persons have been separated.

3. In this background, counsel for the petitioner seeks liberty to withdraw the present application to move for

Patna High Court CR. MISC. No.13892 of 2024(3) dt.19-04-2024 2/2 operation of the order which has already been passed in favour of the petitioner.

4. Permission granted.

5. Accordingly, this application is hereby disposed off granting liberty to the petitioner to avail the remedy already available to the petitioner vide order dated 19.10.2023 passed in Cr. Misc. No.68432 of 2023.
