JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-04-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under sections 135 of the electricity Act. As per the prosecution case, petitioner consumed energy and did not make payment and thus there is dues of 1.17 lakh against this petitioner.

Learned counsel for the petitioner submits that at this stage petitioner is ready to pay 50 per cent of the dues amount subject to final decision of the case.

In that view of the matter, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate

Patna High Court CR. MISC. No.6168 of 2023(3) dt.25-04-2023 2/2 Katihar in connection with Katihar town with P.S. case no 108 of 2022, provided the petitioner deposits 50 per cent of the aforesaid dues before the Company and submit a receipt to this effect while furnishing the bail bonds.
