In this case, the petitioner is seeking regular bail in connection with Saharsa P. S. Case No. 999 of 2015 for the offences under Sections 302, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per the F.I.R, it has been stated that the informant received a call about the gun shot of his son and has been admitted in the Saharsa Hospital when he along with his family members reached there he found his son to had died. He also alleged that in the firing Shambhu Kumar Das also received injury.

During investigation, the mother has also given her statement and where it has been stated that on the repeated call of Shambhu Kumar Das, his son had gone to meet and later on,

Patna High Court Cr.Misc. No.8183 of 2016 (3) dt.21-04-2016 2/2 he was shot at. On perusal of the case diary, it appears that Shambhu Kumar Das has been examined and he has stated that some unknown persons have fired and on that account, the victim has died. He has also received injury, save and except, the suspicion, no material has been collected by the police to suggest implication of the petitioner.

Learned counsel for the informant has submitted that he has filed a petition before the court below making allegation that Shambhu Kumar Das was connived with those persons in killing the son of the informant. Be that as it may, the record does not disclose that the petitioner is involved in this incident though the parents has made statement about the land dispute. Having considered the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in connection with Saharsa P.S. Case No. 999 of 2015.
