The petitioner seeks regular bail in connection with Bettiah Town P.S.Case No.213 of 2019 registered for offences punishable under Sections 413 and 414 of the Indian Penal Code.

There is recovery of two stolen motorcycles and one half part of the motorcycel from one co-accused who disclosed the name of the petitioner as the person with him he has committed theft of one motorcycle.

Submission of the learned counsel for the petitioner is that except the confessional statement of the co-accused there is nothing against him and he is accused in one more case but

Patna High Court CR. MISC. No.2551 of 2020(2) dt.20-01-2020 2/2 he is on bail in that case and he is in custody for four months. As the charge sheet has already been submitted, there is no chance of tampering with the evidence.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Bettiah, West Champaran in connection with Bettiah Town P.S.case No.213 of 2019.

With the above direction, this application is allowed.
