1. Heard the Learned counsel for the petitioner as well as the Learned counsel for the respondents.

2. During the course of arguments, the Learned counsel for the petitioner submitted that he intends to file a complaint before the concerned police station to investigate the matter as to how and why the vehicle was seized by Respondent No. 5 without any order of this Court.

In order to support his contentions, the Learned counsel for the petitioner relied upon the judgment of this Court passed in the case of Dhananjay Seth Versus Union of India passed in CWJC No. 3456 of 2021, with batch matters, vide order dated 19.05.2023, wherein the Co-ordinate Bench of this Court issued certain observations and directions in Para No. 64. Having discussed the entire facts and circumstances of the case and the laws on the subject, this Court would make it clear that so far as the allegations against the Banks and Financial Institutions that they had forcibly seized/repossessed the vehicles is concerned, this Court, instead of dwelling much upon that issue in the present proceeding, leaves it open for the Investigating Agency to look into the complaints of the petitioners and investigate them independently and in accordance with law.

4. In view of the aforesaid judgment of the Co-ordinate Bench of this Court, the petitioner now seeks liberty to make an appropriate complaint

Patna High Court CWJC No.2808 of 2023 dt.22-07-2026 3/3 before the police authorities to investigate the matter independently in accordance with law.

5. Therefore, without going into the merits of this case, this Court directs the petitioner to make a proper complaint before the concerned Police Station within one month from the date of receipt of this order. In turn, the Police shall investigate this case independently, in the light of the observations mentioned in the aforesaid CWJC No. 3456 of 2021 with batch cases.

6. With the aforesaid observations, the Writ petition stands disposed of.
