The petitioner seeks bail in Sasaram Nagar (Tilauthu) P.S. Case No. 973 of 2014, registered for the offences punishable under Sections 302 and 34 of the Indian Penal Code. The informant made allegation that the petitioner Binod Sah armed with Rama and Ganesh Sah with Baishakhi assaulted Meghnath Sharma.
Learned counsel for the petitioner submits that the petitioner and Ganesh Sah were alleged to have assaulted the deceased with hard and blunt object, but the learned Sessions Judge has granted bail Ganesh Sah on the ground that he is an old man of about 70-80 years. It is further submitted that there is counter version bearing Tilauthu P.S. Case No. 980 of 2014.
Patna High Court Cr.Misc. No.3526 of 2015 (3) dt.30-03-2015 2/2 It appears that there is very specific allegation against the petitioner that he assaulted Meghnath Sharma with hard and heavy object on his head and on account of such injury Meghnath Sharma died during the course of treatment.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected. However, the court below is directed to expedite the trial and conclude the same within one year from the date of receipt/production of a copy of this order.
