The petitioners have prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 504, 307,/34 of the Indian Penal Code The allegation against the petitioners along with coaccused person is that they assaulted the informant by means of stones due to which he sustained head injury. Learned counsel for the petitioners submit that the petitioners are innocent and have committed no offence. They have falsely been implicated in this case due to dirty village
Patna High Court CR. MISC. No.10426 of 2023(2) dt.04-05-2023 2/2 politics. There is no specific allegation of assaulting leveled against the petitioners rather general and omnibus allegation leveled against them. It is submitted that alleged occurrence held on 04.09.2022 but FIR has bee lodged by the informant on 03.10.2022 without given any cogent reason. It is further submitted that the petitioners have got no criminal antecedent moreover, they are languishing in judicial custody since 12.10.2022.
Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioners, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Obra P.S. Case No. 393 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad.
