====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-02-2025 Heard learned counsel for the petitioner and the State.

2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 147, 148, 149, 341, 323, 307, 120B of the Indian Penal Code and section 27 of the Arms Act.

3. As per the prosecution case, while the informant was returning to his house, all the FIR named accused persons including this petitioner intercepted and abused him. In the meantime, co-accused Chotu Singh made firing which hit on the left hand of the informant.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. There is no specific overt act has been alleged against the petitioner who at best be said to be present

5. Learned counsel for the State opposes the prayer for bail.

6. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in Udwantnagar Police Station Case No. 453 of 2023, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
