2. The petitioner seeks regular bail in a case registered for the offence under Sections 414 of the Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act.
3. It has been submitted by the learned counsel for the petitioner that though the charge has been framed on 19.06.2023 but no witness(s) has been examined yet in the case and the petitioner may be granted bail because of the delay in trial. The petitioner is in jail since 13.10.2022.
4. Learned APP for the State has vehemently opposed the prayer for bail and has submitted that petitioner has three criminal antecedents also.
5. Considering the criminal antecedents of the
Patna High Court CR. MISC. No.4743 of 2024(4) dt.10-04-2024 2/2 petitioner, I am not inclined to grant bail to the petitioner.
6. Accordingly, this application for bail is dismissed.
7. The Superintendent of Police, Vaishali is directed to produce the witnesses on each and every date regularly and get the trial concluded at the earliest. Failure to do so will result in appropriate order/action against the Superintendent of Police, Vaishali and his subordinates.
8. Mr. Jharkhandi Upadhyay, learned APP will coordinate with the Superintendent of Police, Vaishali.
9. If the trial is not concluded within the next six months because of the fault of the prosecution, the petitioner may renew his prayer for bail.
10. Let a copy of this order be communicated to the Superintendent of Police, Vaishali through FAX for its compliance forthwith.
