ANJANA MISHRA ORAL ORDER 05-12-2017 Heard learned counsel for the petitioner and Mr. Anjani Kumar, learned Senior Counsel appearing on behalf of the BSFC as well as the learned counsel for the State. As per the earlier direction issued by this Court, an Interlocutory Application, bearing I.A. No.8755 of 2017, has been filed praying for dispensing with the personal appearance of the Managing Director (O.P. No.3).

Learned counsel for the BSFC submits that the order under contempt has now been complied with and, therefore, his personal appearance may be dispensed with as on

Patna High Court MJC No.950 of 2017 (8) dt.05-12-2017 2/2 receipt of the required fund, the District Manager, BSFC, Aurangabad has issued two cheques; bearing cheque no.044978 for Rs.22,32,834/- and cheque no.044976 for Rs.4,88,557/-. In view of such statements made in the affidavit, the personal appearance of the Managing Director (O.P. No.3) is dispensed with.

This Court is informed that the District Manager (O.P. No.4) is in attendance before this Court. The said two cheques have been handed over to the learned counsel for the petitioner.

As the order under contempt now stands complied with, I.A. No. 8755 of 2017 and also the M.J.C. application stand disposed of.
