Petitioner seeks bail in a case registered under section 302/34 of the Indian Penal Code as well as section 27 of the Arms Act.
Informant claimed himself to be eye-witness of the alleged occurrence and stated that the petitioner and co-accused Manoj Singh opened fire causing firearm injuries to the deceased but submission on behalf of the petitioner is that post mortem report of the deceased completely negates the aforesaid allegation because only one injury was found on the person of the deceased.
Post mortem report of the deceased shows that two injuries were found on the person of the deceased but one injury is wound of entry whereas another injury is wound of exist and, therefore, the aforesaid fact goes to show that only one fire was hit to the deceased.
Patna High Court Cr.Misc. No.7184 of 2016 (4) dt.15-03-2016 Petitioner does not have any criminal antecedent and investigation against him has already been completed. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri Kumar Madhvendra, Judicial Magistrate, Ist Class, Danapur District Patna in Naubatpur P.S. Case no. 597/2015.
