The petitioner seeks bail in connection with Pakaridayal P.S. Case No. 297 of 2019, registered for offence punishable under Sections 354(A), 354(B) and 34 of the Indian Penal Code and Section 67(A) of the Information Technology Act.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Further submission is that there is inordinate delay of five days without explaining plausible delay. He further submits that earlier father of the co-accused has lodged two cases vide Patahi P.S. Case No. 88 of 2019 and Patahi P.S. Case No. 109 of 2009 against Devar, father-in-law

Patna High Court CR. MISC. No.1575 of 2020(2) dt.23-01-2020 2/2 and others family members of the informant and in retaliation of the same the present case been lodged against the petitioner. The petitioner has no criminal antecedent and he is in custody since 23.09.2019.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above-named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-5th, East Champaran, Motihari in connection with Pakaridayal P.S.
