The petitioner seeks bail in a case registered for the offence under Section 302, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, some unknown miscreants, riding on two motorcycles, committed murder of brother of the informant by making indiscriminate firing. Petitioner is not named in the F.I.R. Name of the petitioner has transpired during course of investigation only on the material that he was seen riding on same motorcycle, which was used by the miscreants in commission of the offence. Save and except this, there is no other material to show complicity of the petitioner in the aforesaid occurrence. Co-accused Sonu

Patna High Court CR. MISC. No.64586 of 2021(3) dt.12-04-2022 2/2 Mishra, who is alleged to be one of the conspirator, has been granted bail by this Court, vide order dated 01.12.2021 passed in Cr.Misc. No. 53128 of 2021. Petitioner is in custody since 07.01.2021. Investigation is complete.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 19th, Muzaffarpur in connection with Sessions Trial No. 182 of 2021, arising out of University P.S.
