JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-04-2016 Heard learned counsel for the petitioner and the State. The petitioner is an accused in connection with Beldaur P.S.Case No. 125 of 2015 registered under Sections 397 of the Indian Penal Code and 27 of Arms Act, pending in the Court of Sri Pankaj Chandra Verma, learned Judicial Magistrate, 1st Class, Khagaria.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the FIR. He further submits that it has come in course of investigation that the looted mobile of the informant is said to have been recovered from the house of petitioner. He also submits that the petitioner is in custody since 13.07.2015.
On the other hand, learned A.P.P. opposes the prayer of
Patna High Court Cr.Misc. No.9662 of 2016 (3) dt.28-04-2016 bail of the petitioner and submits that looted mobile of Zen Company has been recovered from the house of the petitioner, as detailed in paras 132 and 133 of the case diary. Having considered the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail and same is rejected.
