JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 18.10.2014 in a case registered for the offence punishable under Section 395 of the Indian Penal Code.

Petitioner is not named in the first information report and his name surfaced in confessional statement of co-accused, Bhabhikshan Yadav. Apart from this, petitioner carries criminal antecedent of some cases.

Admittedly, up till now, petitioner has not been put on Test Identification Parade nor anything has been recovered from his conscious possession.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on
