JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 30-01-2019 The petitioner, who has retired as a Health Worker, is aggrieved by the fact that the 1st and 2nd A.C.P. and M.A.C.P. have been given to him but on the pay-scale of a Dresser even though he had joined the service as a Health Worker and retired as a Health Worker.

In support of the aforesaid contention, Ms. Mallika Mazumdar, the learned counsel for the petitioner has submitted that the appointment letter, various postings in the service tenure of the petitioner and the L.P.C. described the petitioner as Health Worker and not a Dresser. However, the benefits under the A.C.P. and M.A.C.P. schemes have been given to the petitioner as if he were a Dresser. A representation to that effect has also been made by the petitioner before the Civil Surgeon-Cum-Chief Medical Officer, Supaul (respondent No. 6), but it has not yet been acted upon.
3. Under the aforesaid circumstances, the petitioner is directed to make a fresh representation before the Civil Surgeon-Cum-Chief Medical Officer, Supaul (respondent No. 6) within a period of three weeks from today along with a copy of this order.
4. On receipt of such representation, the Civil Surgeon-Cum-Chief Medical Officer, Supaul (respondent No.
6) shall dispose off the same within a period of six weeks thereafter. In case, the claims of the petitioner are found to

5. With the aforesaid observation and direction, the writ petition stands disposed off.
