Petitioner is seeking anticipatory bail in connection with Lalganj P.S. Case No. 302 of 2018 registered for the offences punishable under Sections 406/420 of the Indian Penal Code and Section 138 of the N.I.Act.

It appears on perusal of the records that so far as this petitioner is concerned he is not the signatory of the cheque which stood dishonoured on presentation. It is the case of the petitioner that he is nowhere involved in the alleged transactions between the informant and his brother, Md. Parwej Alam who is the owner of M/s J.K. Traders.

Learned A.P.P. for the State is present and has opposed the prayer for bail.

No.3153 of 2019(2) dt.29-01-2019 2/2 In the given facts and circumstances, where it appears on perusal of the copy of the cheque present at Annexure '2' that the same was issued by Md. Parwej Alam in his capacity as proprietor of M/s. J.K. Traders, in case of arrest or surrender of the petitioner within four weeks from today, let the petitioner namely, Md. Faiz Alam alias Fez Alam be released on bail on furnishing bail bond of Rs.15,000/-(rupees fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M, Vaishali, Hajipur in connection with Lalganj P.S. Case No.302 of 2018, subject to the condition that petitioner shall join the investigation by reporting to the Investigating Officer within a period of two weeks from today and shall cooperate in course of investigation, failing which the Investigating Officer shall be at liberty to take steps for cancellation of his bail bond.
