The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 325, 326, 307, 34 of the Indian Penal Code.
Learned counsel for the petitioners seeks permission to withdraw the petition with regard to petitioner No. 2 namely Ram Prasad Yadav since he has
Patna High Court CR. MISC. No.3771 of 2022(2) dt.02-08-2022 2/3 died during the pendency of the present bail petition. Permission is accorded.
Accordingly, the petition with respect to petitioner No. 2 is dismissed as withdrawn.
It is alleged that all the accused persons including the petitioners assaulted the informant, his father and other members of the informant's side when they had gone to resolve the dispute with regard to passage of road.
It is submitted by learned counsel for the petitioners that petitioners there is counter version of the occurrence also and petitioners' side also received grievous injuries. There is general and omnibus allegation against the petitioners. The specific accusation of assaulting with garasa is against co-accused Satyendra Kumar, Ishwari Yadav, Jairam Kumar, Ranjeet Yadav and Golu Kumar who are not petitioners before this Court. In the facts and circumstance of the case, let the petitioners, above named, except petitioner No. 2, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Islampur P.S. Case No. 252 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
