JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-03-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Dalsingsarai P.S. Case No. 79 of 2015 registered under Section 147, 148, 149, 323, 324, 326A, 307 and 504 of the Indian Penal Code.

The accusation is that 12 persons named in the F.I.R. including the petitioner and 100 unknown started to damage the boundary wall of the house of the informant, Lalmuni Devi. When the informant and her daughter, Soni Kumari, made protest then petitioner and one Raju Poddar throw Acid, on which, the informant and her daughter sustained Acid injury.

Patna High Court Cr.Misc. No.9117 of 2016 (2) dt.28-03-2016 Learned counsel for the petitioner submits that due to land dispute the occurrence took place, in which, the prosecution party also caused injury to Sabita Devi, regarding which, Dalsingsarai P.S. Case No. 78 of 2017 was instituted on the basis of written report of the petitioner. It is further submitted that the injury caused by the informant and her daughter is simple in nature. It is further submitted that petitioner has no criminal antecedent and is in custody since 08.01.2016. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Dalsingsarai, Samastipur, in connection with Dalsingsarai P.S.
