JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 20-06-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P for the State.

The petitioner seeks bail in a case for the offences punishable under sections 395 and 412 of the I.P.C The petitioner is not named in the First Information Report which is registered against 10-12 unknown miscreants with the allegation that the miscreants after assaulting the informant committed dacoity in running train and took away bag containing cash and documents from the informant and further snatched valuables from other passengers. During investigation the petitioner was apprehended.

Submission is that nothing has been recovered from conscious possession of the petitioner, he has been arrested merely

Patna High Court Cr.Misc. No.7502 of 2016 (4) dt.20-06-2016 2/2 on suspicion, he is suffering in custody since 30.11.2015 but he has not been put on the test identification parade, charge sheet has already been submitted and there is no chance of tampering with the prosecution evidence.

The learned A.P.P. submits that the petitioner has got criminal antecedent.

In the facts and circumstances as stated above, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Railway Magistrate, Gaya in Gaya Rail P.S. Case No. 115 of 2015, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
