The petitioner is languishing in custody since 25.10.2014 in a case registered for the offences punishable under Sections 394 of the Indian Penal Code and 27 of the Arms Act, subsequently converted into under Sections 395 and 397 of the IPC.
Informant's motorcycle, cash of Rs.10,000/- and other articles were robbed. Subsequently miscreants opened fire but the informant did not receive any injury. It is submitted by learned counsel for the petitioner that the petitioner is not named in the FIR nor any recovery has been made from the petitioner nor the petitioner has
Patna High Court Cr.Misc. No.3061 of 2015 (2) dt.22-01-2015 2/2 been put on TIP. Statement to that effect has been made in para 7 and 8 of the petition.
Considering the fact that the petitioner has not been put on TIP, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar in connection with Shyampur Bhataha P.S. Case No. 72 of 2014.
