The petitioner has filed the instant application for grant of regular bail in connection with Jhanjharpur P.S. Case no. 96 of 2020 registered under sections 304A, 279, 337 and 338 of the Indian Penal Code.

As per allegation in the FIR, it is stated by the informant that his brother was coming on the tractor with the petitioner. As a result of negligent driving by the petitioner, the tractor over-turned resulting in injury to the petitioner while the brother of the informant who was taken to the hospital died in course of treatment.

Patna High Court CR. MISC. No.14100 of 2021(2) dt.02-07-2021 2/2 It is submitted by learned counsel for the petitioner that from perusal of the FIR itself, it is a case of road accident and not of negligence. The petitioner is in custody since 11.9.2020.

The application for bail is opposed by learned Additional Public Prosecutor for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstance of the case and the petitioner having remained in custody for over nine months, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Jhanjharpur P.S. Case no. 96 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. I, Jhanjharpur, District Madhubani.
