2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 111 and 3(5) of the B.N.S. and Sections 30(a), 36, 41(i) and 41(ii) of the Bihar Prohibition and Excise (Amendment) Act.
3. As per prosecution case, 781 litres illicit foreign liquor has been recovered from a pickup van.
4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is innocent and has falsely been implicated in this case merely on suspicion. No incriminating article has been recovered from conscious possession of this petitioner. Petitioner is neither owner nor driver of the vehicle in question.

Patna High Court CR. MISC. No.4140 of 2025(2) dt.24-02-2025 2/2 vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that petitioner is named in the F.I.R. and has also got two criminal antecedents of similar nature.
6. Considering the aforesaid facts and circumstances, huge quantity of recovery and the fact that petitioner has got two criminal antecedents of similar nature, the prayer for grant of anticipatory bail to the petitioner is rejected. (Prabhat Kumar Singh, J) shashank/- U T
