JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-09-2022 The present writ petition has been filed seeking the following reliefs:- "(i) For issuance of a writ in the nature of mandamus directing the concerned respondent authority to remove the encroachment over the land bearing Khata No. 491, Khesra No. 2521, area-5 acre and 25 decimal situated at villageBalbhadrapur, Block-Bahadurpur, P.S. Laheraisarai, District-Darbhanga which has been encroached by the private respondent in connivance with the other official respondent which is resulting in great hardship to the local residents of the area.

(ii) For instituting a high level enquiry committed under the Principal Secretary of Land Revenue Department or any other higher authority of Government to inquire into large scale illegality being committed by the private respondent in connivance with the Government official at the District Level who have been instrumental in grabbing the Government land by playing all sorts of land.

(iii)) For further directing the concerned authorities to take immediate remedial measures so that further government land may not be encroached or grabbed by the respondents in connivance with official at the district level by giving a colour of civil dispute

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the District Magistrate-cum-Collector, Darbhanga for redressal of his aforesaid grievances.

Liberty so sought is granted.

It is needless to state that in case appropriate representation is filed by the petitioner within a period of two weeks from today, the same shall be disposed off by the District Magistrate, Darbhanga, by a reasoned order, in accordance with law, within a period of eight weeks, thereafter. The writ petition stands disposed off.
