JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-01-2019 This application has been filed for cancellation of anticipatory bail granted to opposite party No.2 by learned Additional District and Sessions Judge-II, Bhojpur, Ara vide order dated 4.12.2018 in A.B.P. No. 1908 of 2018. Main contention of learned counsel for the petitioner is that without considering the injury report learned Sessions Judge has granted bail to opposite party No.2 though it is a case under Section 307 IPC.

Heard learned APP and perused the impugned order from which it appears that learned court below has considered the case and granted bail to opposite party No.2 on merit considering that no injury report has been produced by prosecution. In such view of the matter, I am not inclined to

Patna High Court Cr.Misc. No.3053 of 2019(2) dt.29-01-2019 2/2 interfere with the impugned order pass by learned Additional District and Sessions Judge-II, Bhojpur. Accordingly, this application is dismissed.
