JUSTICE GOPAL PRASAD ORAL ORDER 18-03-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is in custody since 21.12.2015 in connection with Murliganj P.S. Case No. 107 of 2014 registered for the offences punishable under Sections 147, 148, 149, 323, 341, 307, 504 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that there is no allegation against the petitioner. It is further submitted that as per the allegation made in the FI.R. all the named accused persons arrived at the house of the informant and started indiscriminate firing upon the informant but the informant did not receive any injury and neither any sign of injury was found on the body of the informant nor any empty cartridge was found or seized from the

Patna High Court Cr.Misc. No.8844 of 2016 (2) dt.18-03-2016 2/2 place of occurrence, which put the prosecution case in doubt. It is further submitted that there is land dispute between the parties. Considering the aforementioned facts and circumstances of the case as also that the petitioner has no criminal antecedent, let the petitioner above-named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhedpura, in connection with Murliganj P.S. Case No. 107 of 2014.
