The petitioner seeks bail in a case registered for the offence under Section 365 of the Indian Penal Code. As per the F.I.R., the informant suspects that this petitioner alongwith other co-accused abducted his father for committing his murder, since two days prior to the occurrence, the accused persons had threatened that they would not allow them to celebrate Holi festival. The father of informant is still traceless.

It is submitted on behalf of petitioner that save and except suspicion, there is no other material to show involvement of this petitioner. Though, altogether six persons have been made accused, but no specific allegation has been made against petitioner and he is in custody since 25.09.2021.

No.3217 of 2022(3) dt.10-05-2022 2/2 However, learned counsel for the informant vehemently opposed prayer for bail and submitted that during course of investigation, tin paragraph 5 & 6 of the case diary, two witnesses have supported the prosecution case and stated that they have seen this petitioner alongwith other accused persons abducting the father of informant.

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected.
