2. It has been pointed out by the learned counsel for the respondents that the instant civil misc. application is not maintainable since the impugned order has been passed rejecting the application filed by the petitioner under Order 7 Rule 11 (d) read with Section 151 of the Code of Civil Procedure.

3. Faced with the situation, learned counsel for the petitioner seeks permission to convert the instant civil misc. application into civil revision application under Section 115 of the Code of Civil Procedure.

4. As prayed, he is permitted to do so within four weeks.
