JUSTICE MOHIT KUMAR SHAH ORAL ORDER 29-08-2019 The present writ petition has been filed to restrain the state-respondents from demolishing the house of the petitioner situated at Khata No.506, Khesra No.839, area 6 decimal (house) 3 2/3 decimlas, Mauza-Sheikhpura.
The learned counsel for the petitioner submits that without resorting to any encroachment proceedings, the respondents are seeking to demolish the house of the petitioner, which is existing since several years.
Having regard to the prayer made by the petitioner herein, respondent authorities are directed not to demolish the house of the petitioner without resorting to appropriate
Patna High Court CWJC No.3778 of 2017(2) dt.29-08-2019 2/2 encroachment proceeding and in case such proceedings have been initiated, the respondent authorities are granted liberty to act in accordance with law.
The writ petition stands disposed of on the aforesaid terms.
