JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-07-2021 As prayed for, through Video Conferencing, let the learned counsel for the petitioner remove the defect(s), as pointed out by the office vide its notes dated 18/19.02.2021, within four weeks of starting of the Court proceeding in physical mode in normal course.

Heard learned counsel for the petitioner and the learned A.P.P. for the State, through Video Conferencing. The petitioner seeks bail in connection with Bheldi P.S. Case No.228 of 2017/Sessions Trial No.787 of 2018 registered under Sections 304(B)/34 of the Indian Penal Code. Learned counsel appearing on behalf of the petitioner submits that, earlier, the prayer of the petitioner for grant of bail was rejected thrice on merit, lastly, vide order dated 15.06.2020

Patna High Court CR. MISC. No.13722 of 2021(2) dt.28-07-2021 2/2 passed by this Court in Criminal Misc. No.12702 of 2020 with a direction to the trial court to conclude the trial of the petitioner within six months by taking all effective steps and if the trial of the petitioner will not conclude within the aforesaid six months, the petitioner would be at liberty to renew his prayer for bail after six months. Further submission is that while the period of more than six months has already elapsed after passing of the aforesaid order dated 15.06.2020 passed in Criminal Misc. No.12702 of 2020 by this Court but the trial of the petitioner has not been concluded as yet and the petitioner is in custody since 21.02.2018.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 4th Additional Sessions Judge, Saran at Chapra, in connection with Bheldi P.S. Case No.228 of 2017/ Sessions Trial No.787 of 2018.
