The petitioner apprehends his arrest in a case registered for the offence under Sections 272, 273, 34 of the I.P.C. and Sections 30(a), 36, 38, 41(i) of Bihar Prohibition and Excise Act.

993.60 liters of foreign liquor has been recovered from the house of co-accused Saroj Chaudhary. It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner and he has been made accused in this case only on suspicion. By referring to paragraph 10 of the petition, it is submitted that petitioner was earlier arrested in connection with Pandaul P.S. Case No. 48/2022 under the Excise Act, in which, he has already been granted bail by this Court and thereafter, the petitioner was implicated in one old case i.e. Pandaul P.S. Case No. 55/2021 under the Excise Act as well as in the present case.

No.3388 of 2023(3) dt.28-03-2023 2/2 However, learned A.P.P. for the State vehemently opposed the prayer for anticipatory bail and submitted that petitioner has got three criminal antecedent of similar nature. Considering the same, the prayer for anticipatory bail of petitioner is rejected.
