Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in connection with Riga P.S. Case No. 63 of 2020 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 05.11.2021, charge-sheet has been submitted and has antecedent of one case and is aged about 78 years and allegation is of recovery of 180 litres of liquor behind the house of the petitioner.

Learned counsel for the petitioner submits that the

No.3326 of 2022(2) dt.04-03-2022 2/2 petitioner the petitioner has been falsely implicated in the present case, nothing was recovered from his house, rather the recovery from a place out side the house was made and the petitioner, whose house was near the place of occurrence, came to be falsely implicated.

Learned APP opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.2000/- (Rupees two thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-IIcum- Special Judge, Excise Act, Sitamarhi in connection with Riga P.S. Case No. 63 of 2020.
