ANSHUMAN ORAL ORDER 09-06-2022 Heard learned counsel for the petitioner and the learned counsel for the O.P. No.2, who appeared suo-motu in this case, as well as learned APP for the State. The petitioner seeks regular bail in connection with Jehanabad Mahila P.S. Case No. 36 of 2020 lodged under Sections 323, 342, 498A, 494, 354(B), 504, 506/34 of the Indian Penal Code, 1860 and Section 3⁄4 of the Dowry Prohibition Act. After some argument, learned counsel for the petitioner as well as learned counsel for the O.P. No.2 informed to this Court that they are ready to settle this matter before Mediation Center.
Since petitioner is in custody since 10.09.2021,
Patna High Court CR. MISC. No.3329 of 2022(2) dt.09-06-2022 2/2 Charge sheet has already been submitted and both the parties are ready to settle their dispute before Mediation Center, Jehanabad Civil Court, therefore, without entering into the merit of this case, I am hereby granting bail to the petitioner as the O.P. no.2 has also no objection in the same. Accordingly, I am hereby inclined to grant bail to the petitioner on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Jehanabad in connection with Jehanabad Mahila P.S. Case No.36 of 2020. Both the parties are hereby directed to appear before the Mediation Center, Jehanabad Civil Court within one month from today to settle their dispute under the supervision of the Trial Court.
In case, the party shall not reach at settlement, then Trial Court has liberty to pass appropriate order including the cancellation order.
