2. The petitioner seeks bail in connection with Barhat P.S. Case No. 65 of 2018 registered for the offence punishable under Section 302 of the Indian Penal Code.

3. The petitioner is the assailant of the deceased. Earlier, his application for bail was rejected on 28.11.2018. The petitioner is in jail since 01.06.2018 i.e., he is in custody for 5 years 9 months.

4. In the report from the trial Court, it has come that in the trial out of nine charge-sheeted witnesses, four chargesheeted witnesses have been examined.

5. Considering the delay in trial and the period of custody, this application is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge III, Jamui in connection with Barhat P.S. Case No. 65 of 2018.
