Learned counsel for the petitioner undertakes to remove the defects within three weeks of resumption of normal court proceedings. In the eventuality of non-removal of defects within stipulated period, office will place the matter before the Bench. The petitioner apprehends his arrest in a case registered for the offence punishable u/s 420 and 406 of the IPC. Allegedly, the petitioner has cheated the informant and the villagers in the name of adding their names in the list of old age pension scheme by taking their Aadhar cards and LTI/RTI. Thereafter, he made illegal transaction from their bank accounts. It is submitted by learned counsel for the petitioner that
Patna High Court CR. MISC. No.3225 of 2022(2) dt.13-07-2022 2/3 petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. However, it is submitted that the petitioner is agreed to deposit the amount of Rs.1,13,100/- before the learned court below. Petitioner has no criminal antecedent.
Learned APP for the State opposed the prayer for anticipatory bail.
Having regard to the facts and circumstances of the case, since the petitioner is ready to deposit the total amount tricked by him, let him, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Industrial Area P.S. Case No.103 of 2021, GR No.3261/21, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
However, the bail bond of the petitioner shall be accepted after the deposit of Rs.1,13,100/- before the learned court below and the learned court below, after issuing notice to the victims,
Patna High Court CR. MISC. No.3225 of 2022(2) dt.13-07-2022 3/3 shall disburse the said amount, as per the list of the victims/villagers and amounts which has been withdrawn by the petitioner from their accounts.
