The petitioner apprehends his arrest in Tariyani P.S. Case No. 202 of 2021, registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code and section 3/4 of the POCSO Act.

As per the prosecution case, 27 named and 400 unknown persons pelted stones on the informant (police official) and police party, as a result of which some of the police personnel got injured and the accused persons also damaged the police vehicles.

It is submitted that though petitioner is named in the FIR, but no specific allegation of any overt act has been alleged against this petitioner. Specific allegation of assault is against

Patna High Court CR. MISC. No.3271 of 2022(2) dt.26-07-2022 2/2 other co-accused persons. Petitioner is news reporter of a news channel and he simply went there to cover the news. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Sheohar in connection with Tariyani P.S. Case No. 202 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
