JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-12-2018 The short prayer made by the petitioner in the present writ petition is that without giving any opportunity of hearing to the petitioner or informing him, a sum of Rs.38,874/- has been adjusted from saving account of the petitioner. The learned counsel for the petitioner submits that the petitioner is ready to settle the loan amount and for that he be granted liberty to approach the respondent no.2 for settling the loan amount.

Per contra, the learned counsel for the respondents Bank submits that the petitioner was informed about deduction of the aforesaid amount and the fact is that the petitioner has never repaid the loan taken by him.

Patna High Court CWJC No.2872 of 2017(2) dt.06-12-2018 2/2 Having regard to the respective submissions made by the learned counsel for the parties, I deem it fit and proper to relegate the petitioner to approach the respondent no.2 for settlement of the loan account by way of amicable settlement. It is needless to state that if the petitioner approaches the respondent no.2 within a period of four weeks from today, the respondent no.2 shall make all endeavours to settle the loan account of the petitioner herein expeditiously.
