The petitioner seeks bail in Ahiyapur P.S. Case No. 1065/2017, instituted for offence under Section(s) 414 of the Indian Penal Code.

It is alleged in the written report that during patrolling duty police saw a Glamour motorcycle without number plate standing on road near village- Rasulpur in front of S.K.M.C.H. Petitioner was found standing there. Police apprehended the petitioner and demanded paper of the motorcycle but he could not produce any paper with regard to motorcycle. Learned counsel for the petitioner has submitted that aforesaid motorcycle has not been recovered from conscious

Patna High Court Cr.Misc. No.2719 of 2019(2) dt.22-01-2019 2/2 possession of this petitioner rather the same has been recovered from road in front of S.K.M.C.H. Police has illegally made this petitioner accused in this case and took his signature on the seizure-list.

Seizure-list is part of F.I.R. from which it appears that recovery has been made from the road in front of S.K.M.C.H. Petitioner is in custody since 12.12.2017 having clean antecedent.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate XIIIth, Muzaffarpur in connection with Ahiyapur P.S. Case No. 1065/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
