JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 03.11.2014 in a case registered for the offences punishable under Section 354 of the Indian Penal Code and Section 4 of the Protection of Child from Sexual Offences Act.

It is alleged that the daughter of the informant was coming from the market when 3-4 boys abused and did obscene act with her.

It is submitted by learned counsel for the petitioner that the accusation is not specific when the informant has subsequently retracted from his initial version and filed a petition to that effect before the learned court below. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
