JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 29-02-2020 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners are apprehending arrest in connection with Shikarpur P.S. Case No. 305 of 2019 for offences under Sections 341, 323, 324, 307, 379 and 504/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that there is absolutely no allegation against petitioner no. 1. So far as petitioner nos. 2 and 3 are concerned, they have snatched golden ornament and silver Jhhumka from the wife of the informant. The allegation of assault with lathi, Bhala and sword on the informant is against others and not against these petitioners.

Let petitioners, above-named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs. 50,000/- (Rupees fifty thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, West Champaran, Bettiah in connection with Shikarpur P.S. Case No. 305 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
