The petitioner seeks bail in Gopalpur (Rangar) P.S. Case No.257 of 2014 instituted for the offences under Sections 302, 506/34 of the Indian Penal Code and Section 27 of the Arms Act.
When the informant has heard the sound of firing, he went to the place of occurrence and found deceased riddled with bullets and found dead.
Learned counsel for the petitioner has produced the order passed by this Court in Cr. Misc. No.1292 of 2015 and on that strength he submits that he should also be granted bail. As the order does not disclose the reason for granting
Patna High Court Cr.Misc. No.2611 of 2015 (4) dt.04-03-2015 bail it will not be a binding precedent for this Court to grant bail. Petitioner was identified just after occurrence while fleeing away from the place of occurrence and the victim was found dead.
Looking to the nature of allegation, this Court is not inclined to enlarge the petitioner on bail. Accordingly the prayer for bail is rejected. However, the petitioner will be at liberty to renew his prayer for bail after framing of charge. Vinay/- (Shivaji Pandey, J) U T
