This application for anticipatory bail arises out of Complaint Case No. 453 of 2016 for the offence under Sections 341, 323, 354 and 380/34 of the Indian Penal Code. Petitioner No.1 is the elder brother of the husband of the complainant whereas petitioner No.2 is the wife of petitioner No.1. Allegedly, the petitioners entered into the room of the complainant, assaulted her and breaking open the lock of complainant's box, petitioner No.2 took away certain amount and petitioner No.1 took away the complainant's purse. Learned counsel for the petitioners has submitted that it is because of the family dispute that a false criminal case

Patna High Court Cr.Misc. No.4604 of 2019(2) dt.29-01-2019 2/2 has been lodged.

Be that as it may, in the nature of allegation made, a case of grant of anticipatory bail is made out. This application is accordingly allowed.

Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Sasaram, in Complaint Case No. 453 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.

This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
