The petitioner is accused in connection with Hathua P.S. Case No. 135 of 2015 registered under Sections 399, 402, 307, 414 and 353 of the Indian Penal Code and Sections 25(1-b)A, 26, 27 and 35 of the Arms Act.
The accusation is that petitioner and five others were apprehended by the police in course of preparation to commit the Dacoity. On search, petitioner was found in possession of one country made pistol along with cartridge whereas co-accused, Rafi Alam and Bhola Mian were also found in possession of country made pistols with cartridges.
Learned counsel for the petitioner submits that
Patna High Court Cr.Misc. No.9195 of 2016 (2) dt.29-03-2016 petitioner is in custody since 28.07.2015. It is further submitted that similarly situated co-accused, Rafi Alam has already been granted privilege of bail by a bench of this Court vide order dated 04.02.2016 passed in Criminal Misc. No. 3580 of 2016. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the J.M. Ist Class, Gopalganj, in connection with Hathua P.S. Case No. 135 of 2015. Out of two sureties, one surety must be the close relative of the petitioner.
