The petitioner apprehends his arrest in Konch P.S. Case No. 302 of 2021, registered for the offences punishable under Sections 419, 420 of the Indian Penal Code and section 7 of the Essential Commodities Act.

As per the prosecution case, total 638 bags of Urea loaded on three vehicles were seized by the police. Driver of the truck was apprehended on the place of recovery. It is submitted that petitioner has been accused in this case because he is owner of the seized truck and has got no concern with the seized fertilizer and without his knowledge and consent driver of truck loaded Urea. Petitioner is not the dealer

Patna High Court CR. MISC. No.3470 of 2022(2) dt.28-07-2022 2/2 of fertilizer. The truck in question is a public carrier truck. Petitioner has got clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Gaya in connection with Konch P.S. Case No. 302 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
