JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 04-03-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in connection with Salkhua P.S. Case No. 193 of 2010 registered for the offences punishable under sections 341, 323, 324, 307, 302 read with 34 and 120B of the Indian Penal Code and 27 of the Arms Act.

It has been contended that the petitioner is neither named in the FIR nor any witness has taken his name in course of investigation of the case. He being a man of clean antecedent has been apprehended only because from the looted mobile of the informant a call was made on his mobile phone. Learned counsel for the State has opposed the prayer for

Patna High Court Cr.Misc. No.3222 of 2015 (3) dt.04-03-2015 2/2 bail. He has submitted that the petitioner has been apprehended on suspicion on the basis of conversation made on his mobile by the looted mobile set of the informant.

Having regard to the facts and circumstances of the case, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Salkhua P.S. Case No.193 of 2010.
