The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 448, 307, 379 and 504/34 of the Indian Penal Code. Allegation is that other co-accused committed assault at the shop of the informant and petitioner committed theft of Rs.25,000/- (Twenty Five Thousand).
Submission is that false implication is there for the reason that informant was arrested in connection with Tajpur P.S. Case No. 386 of 2017, a case registered under the provisions of the Bihar Prohibition and Excise Act, 2016. The informant suspected that the petitioner and others were informer of the police. Further submission is that the Doctor has found simple injury on the injurds.

No.2858 of 2019(2) dt.22-01-2019 2/2 Considering the nature of allegation and the fact that the petitioner has got no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending in connection with Patepur Police Station Case No. 115 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
